ملخص:

تناول البحث نمط من أنماط الحماية المكرسة لحقوق الإنسان, ألا وهي حماية حقوق الإنسان على المستوى الإقليمي, من خلال الاتفاقيات الإقليمية واليات الحماية المنبثقة عنها, مع تناول المحكمة الأوروبية لحقوق الإنسان كنموذج تطبيقي لهذه الدراسة, لأن هذه الأخيرة تحتل مكانة كبيرة في مجال الرقابة على حقوق الإنسان عموماً, وعلى الاتفاقية الأوروبية لحقوق الإنسان وحرياته الأساسية بصورة أخص, باعتبارها جهازا قضائيا إقليميا نوعيا لم تأتي به أي اتفاقية من قبل.

Abstract

This research paper deals with a type of protection devoted to human rights, namely, the protection of human rights at the regional level, through regional conventions and the protection mechanisms emanating from them, with the European Court of Human Rights as an applied model for this study, because the latter occupies a great position in the field of oversight On human rights in general, and on the European Convention on Human Rights and Fundamental Freedoms in particular, as it is a qualitative regional judicial body that has not been included in any agreement before.The research showed that the development of the European system for the protection of human rights reflects the capacity for legal innovation and innovation, both in terms of form and substance, so that the European Court responds effectively to the qualitative and quantitative changes required by the effective protection of human rights.The European mechanism for the protection of human rights is considered the most developed and influential regional mechanism, as it has gone beyond the borders of the Council of Europe to include some international criminal judicial bodies that have been taken into consideration by the jurisprudence of the European Court.
