الملخص:

هدفت هذه الورقة البحثية إلى دراسة وتحليل المسألة الدستورية وعملية الانتقال السياسي في الجمهورية اليمنية، خلال الفترة الممتدة من 11 شباط/ فبراير 2011 تاريخ انطلاق شرارة الثورة الشبابية في الجمهورية اليمنية وحتى 21 كانون الثاني/ يناير 2015 تاريخ تقديم رئيس الجمهورية ورئيس الوزراء استقالتهما، ومن ثم انهيار العملية السياسية، وتعثر عملية الانتقال السياسي في البلاد. وقد ركزت الورقة على دراسة وتحليل مكانة الدستور النافذ في عملية الانتقال السياسي في الجمهورية اليمنية، من خلال دراسة وتحليل موقعه في مبادرة مجلس التعاون لدول الخليج العربية، ومن ثم دراسة وتحليل موقعه في الآلية التنفيذية للمبادرة الخليجية. وكذلك دراسة وتحليل آلية وضع دستور جديد في الجمهورية اليمنية، من خلال دراسة وتحليل مؤتمر الحوار الوطني، بالتركيز على دراسة وتحليل الفاعلون الرئيسيون المشاركون في مؤتمر الحوار الوطني، ومن ثم دراسة وتحليل قضايا الحوار الوطني، وكذلك دراسة وتحليل محددات توزيع أعضاء المؤتمر على فرق الحوار الوطني، وآلية اتخاذ القرارات فيها. بالإضافة إلى دراسة وتحليل القضايا الخلافية في مسودة الدستور الجديد في الجمهورية اليمنية، من خلال التركيز على دراسة وتحليل القضية الجنوبية، وقضية تحديد الأقاليم.

Abstract

This research paper aimed to study and analyze the constitutional issue and the political transition process in the Republic of Yemen, during the period which was extending from February 11, 2011, the date of the start of the youth revolution in Yemen, until January 21, 2015, the date of the resignation of the President of the Republic and the Prime Minister, and then the collapse of the political process, and the faltering of the political transition process in the country. The research paper focused on studying and analyzing the status of the effective constitution in the process of political transition in the Republic of Yemen, by studying and analyzing its position in the initiative of the cooperation council for the Arab states of the Gulf, and then studying and analyzing its position in the executive mechanism of the Gulf initiative.

As well as studying and analyzing the mechanism of drafting a new constitution in the Republic of Yemen, through the study and analysis of the National Dialogue Conference (NDC), focusing on the study and analysis of the main actors participating in the NDC, and then studying and analyzing the issues of the National Dialogue. Also, studying and analyzing the determinants of distributing the members of the NDC teams and its decisions-making mechanism.

Additionally, studying and analyzing the controversial issues in the draft of the new constitution in the Republic of Yemen, by focusing on the study and analysis of the southern issue, and the issue of defining the regions.
