ملخص :
هدفت هذه الدراسة إلى توضيح المقصود بالعمل الطبي، وأساس إباحته، وبيان أساس قيام المسؤولية الجنائية للطبيب، وتوضيح أركان المسؤولية الجنائية للطبيب، وإبراز وسائل إثبات المسؤولية الجنائية للطبيب.
وقد جاءت مشكلة الدراسة من خلال التساؤل: ماذا يقصد بالمسؤولية الجنائية للطبيب؟ وما أبرز أركان تلك المسؤولية الجنائية؟
وقد اتبعت خلال هذه الدراسة المنهج المقارن لمناسبته ذلك النوع من الدراسات.
وقد خرجت بعدة نتائج أبرزها: لا يمكن إقرار المسؤولية الجنائية للطبيب إلا بتوافر أركانها وهو الخطأ والضرر وعلاقة السببية، تتقرر المسؤولية الجنائية للطبيب بعد ارتكابه الخطأ الطبي سواء كان مادي أو مهني، وسواء كان بسيط أم جسيم.، كما أن الخطأ الطبي يعد تقصير في مسلك الطبيب وهو لا يقع من طبيب يقظ وجد في ذات الظروف الخارجية التي أحاطت بالطبيب المسؤول عن الخطأ.
كما خرجت بعدة توصيات أبرزها: ضرورة وضع إطار للمسؤولية الجنائية للطبيب في ضوء الضوابط القانونية وتأكيد نسبة الخطأ لمرتبكه بشكل مباشر، ووجوب تشديد العقوبات في مجال ارتكاب الجرائم العمدية كالإجهاض وكذلك امتناع الطبيب عن تقديم المساعدة وغيرها من الجرائم، ضرورة تفعيل دور نقابة الأطباء الموجودة لمعرفة سبب الأخطاء أو الجرائم الطبية نظرًا لكثرتها وانتشارها، وأن يكون هناك متابعة للطبيب والتزامه بمواكبة التطورات العلمية والمستجدات العصرية في فنون وأساليب العلاج في مهنة الطب.
abstract
This study aimed to clarify what is meant by medical work, the basis for its permissibility, and to explain the basis for establishing the criminal responsibility of the doctor, and to clarify the elements of the criminal responsibility of the doctor, and to highlight the means of proving the criminal responsibility of the doctor.
The problem of the study came through the question: What is meant by the criminal responsibility of the doctor? What are the most prominent elements of that criminal responsibility?
During this study, the comparative approach was followed due to its suitability for this type of studies.
It came out with several results, most notably: The criminal responsibility of the doctor cannot be recognized unless its elements are available, which is the error, the damage, and the causal relationship. The criminal responsibility of the doctor is decided after he commits a medical error, whether it is material or professional, and whether it is simple or serious., And the medical error is considered a negligence in behavior. The doctor, who does not fall from an alert doctor who was found in the same external circumstances that surrounded the doctor responsible for the error.
It also came out with several recommendations, most notably: the need to establish a framework for the criminal responsibility of the doctor in the light of legal controls and to confirm the percentage of error directly to the perpetrator, and the necessity of tightening the penalties in the field of committing intentional crimes such as abortion, as well as the doctor’s refusal to provide assistance and other crimes, the need to activate the role of the existing Doctors Syndicate to find out the reason Medical errors or crimes due to their abundance and spread, and that there is a follow-up of the doctor and his commitment to keep abreast of scientific developments and modern developments in the arts and methods of treatment in the medical profession.
