Résumé :

Le nouveau cadre constitutionnel des élections communales et régionales au Maroc

La constitution de 2011 a exploréune courbe décisive dans la vie politique au Maroc. S’inscrivant dans une évolution institutionnelle que le pays a esquissée en 1962, cette loi fondamentale a installé une nouvelle philosophie de l’organisation territoriale du Royaume en annonçant au premier article que celle-ci est décentralisée et fondée sur une régionalisation avancée.Cet article porte un éclairage sur les nouveaux pas franchis par la constitution dans le processus électoral local afin de donner un élan à l’opération démocratique en renforçant les garanties juridiques des échéances électorales permettant une représentation sincère dans une arène électorale neutre et loyale.

Abstract :

The 2011 constitution explored a decisive curve in Moroccan political life. As part of an institutional evolution that the country outlined in 1962, this fundamental law established a new philosophy of the territorial organization of the Kingdom by announcing in the first article that this organization is decentralized and based on advanced regionalization.This article sheds light on the new steps taken by the constitution in the local electoral process in order to give impetus to the democratic operation by strengthening the legal guarantees of the electoral deadlines allowing sincere representation in a neutral and fair electoral arena.

الملخص:

حددت الوثيقة  الدستورية لسنة 2011 منحنى حاسما في الحياة السياسية في المغرب. في إطار التطور المؤسساتي الذي حددته البلاد منذسنة 1962، قام هذا النص الدستوري بتثبيت فلسفة جديدة للتنظيم الترابي للمملكة من خلال الإعلان في الفصل الأول أن هذا التنظيم لا مركزي ويستند إلى الجهوية المتقدمة.يلقي هذا المقال الضوء على الخطوات الجديدة التي أقرها الدستور في أفق تحصين العملية الانتخابية من أجل إعطاء زخم للعملية الديمقراطية وتعزيز الضمانات القانونية للاستحقاقات الانتخابية لكي تسمح بتمثيل حقيقي ونزيه في ساحة انتخابية تضمن التنافسية والحياد.
