الملخص:

تسلط هذه الدراسة الضوء على تأمين إصابات العمل في الضمان الإجتماعي الأردني، فإصابات العمل هي السبب في ظهور فكرة التأمينات الإجتماعية، وهي الأساس من وجود الضمان الاجتماعي من أجل حماية العاملين من حوادث العمل وأمراض المهنة. فكان لا بد من الإهتمام بسلامة العاملين وصحتهم، وزيادة نطاق الحماية المقررة للعامل، وقد أخذت مسألة سلامة العمال والتعويض عن إصابات العمل إهتماماً بالغاً وملحوظاً في كافة تشريعات العالم، وأصبح التأمين على إصابات العمل يغطي الإصابة منذ اللحظة الأولى لإلتحاق العامل بالعمل.

وعليه فإن هذه الدراسة تبيّن مفهوم إصابة العمل التي تدخل في التأمين، وصور إصابات العمل، وإجراءات حصول العامل المصاب على منافع تأمين إصابات العمل من الضمان الإجتماعي الأردني. فكان تعريف إصابة العمل بأنها: (أية أضرار أو إصابة جسدية للعامل ناتجة عن أداء العامل لمهام وظيفته أو بمناسبتها، وتشمل حوادث العمل المفاجئة أينما وقعت وبأية صورة وقعت، وتشمل أمراض المهنة، ما دامت الإصابة ذات صلة بالنشاط المهني للعامل، وسببت للعامل خللاً في قدرته على الإستمرار في أداء عمله كالمعتاد).

وبينت الدراسة صور حوادث العمل المسببة للإصابة، سواء كان الحادث قد وقع داخل مكان العمل أو خارجه أو أثناء الطريق من العمل وإليه، وثم بيّنت الدراسة شروط إصابة العمل التي يكفلها الضمان الإجتماعي.

وبينت الدراسة أيضاً الإجراءات والخطوات التي رسمها المشرع الأردني من أجل حصول العامل المصاب على التأمين والمنافع من الضمان الإجتماعي؛ من حيث ما هي تلك المنافع والمزايا، وما هي اللجان المختصة بإصابات العمل في مؤسسة الضمان الإجتماعي، وكيف يسير العامل المصاب أو ذويه أو المنشأة التي يعمل فيها بالإجراءات والخطوات من أجل حصوله على التأمين والمنافع المقررة، وما هي إلتزامات المنشأة أو رب العمل منذ اللحظة الأولى لوقوع الإصابة وحتى حصول العامل المصاب على المنافع والمزايا من الضمان الاجتماعي.

Abstract

This study sheds light on the insurance of work injuries in the Jordanian social security. Work injuries are the reason for the emergence of the idea of ​​social insurance, which is the basis for the existence of social security in order to protect workers from work accidents and occupational diseases. It was necessary to pay attention to the safety and health of workers, and to increase the scope of protection granted to the worker, and the issue of worker safety and compensation for work injuries has taken great and noticeable attention in all legislations of the world, and insurance for work injuries covers the injury from the first moment the worker joined the work.

This study shows the concept of work injury that is included in insurance, forms of work injuries, and procedures for the injured worker to obtain work injury insurance benefits from the Jordanian Social Security. The definition of a work injury was: (Any damage or bodily injury to the worker resulting from the worker’s performance of the duties of his job or on the occasion thereof, and it includes sudden work accidents wherever they occur and in any form that occurred, and includes occupational diseases, as long as the injury is related to the worker’s professional activity, and causes the worker to defect in his ability to continue to do business as usual).

The study showed pictures of work accidents that cause injury, whether the accident occurred inside or outside the workplace or on the way to and from work, and then the study showed the conditions of work injury guaranteed by social security.

The study also showed the procedures and steps drawn up by the Jordanian legislator in order for the injured worker to obtain insurance and benefits from social security; In terms of what are those benefits and benefits, and what are the committees concerned with work injuries in the Social Security Institution, and how the injured worker or his family or the facility in which he works proceeds with the procedures and steps in order to obtain insurance and the prescribed benefits, and what are the obligations of the facility or the employer from the first moment due to the occurrence of the injury until the injured worker obtains benefits and benefits from social security
