ملخص :
تحرص الدول على تضمين دساتيرها، الآليات التي يتم من خلالها تشكيل السلطات الدستورية في الدولة، وكيفية تجديدها، والنص على الضوابط التي تضمن استمراريتها. ويأتي على رأس تلك السلطات منصب رئيس الدولة، فهي تنص عادة على إجراء انتخابات رئاسة الدولة قبل مدة من نهاية الولاية الرئاسية، منعاً من الوصول إلى الفراغ في سدة الرئاسة.
إلا أن جميع تلك الاحتياطات قد لا تنفع ونصل إلى الشغور في منصب الرئاسة، بسبب وفاة الرئيس أو استقالته أو أي سبب آخر، فنجد أن الدساتير قد وضعت حلولاً لهذه الحالات تضمن استمرارية السلطات الدستورية، وذلك من خلال تحديد الشخص أو الجهة التي تتولى صلاحيات الرئيس خلال فترة الشغور. كما يعمد قسم منها إلى تنظيم حالة الشغور التي قد تلحق بالرئاسة المؤقتة للدولة. ولا تكتفي الدساتير بذلك فهي تضع بعض الضوابط لعمل الرئيس المؤقت، منعاً لاستغلال هذا المنصب، فتارة نجدها تحد من صلاحيات الرئيس المؤقت، وتارة أخرى تقيد قسماً منها، وهو ما سيكون له التأثير البالغ على السلطات الدستورية الأخرى في الدولة، لا سيما السلطتين التنفيذية والتشريعية.
فمن هي الجهة التي تتولى صلاحيات رئيس الجمهورية في حالات الشغور الرئاسي في مصر؟ وهل من فارق بين من يتولاها في حالات الشغور المؤقت، وبين من يتولاها في حالات الشغور الدائم؟ وماذا عن حالات الشغور المركب؟ ومن يتولاها في حالات الشغور الرئاسي في زمن الحرب؟
تم بحث هذه الأسئلة، من خلال عرض كيفية تعاطي الدساتير المصرية المتعاقبة مع هذه القضايا، بالإضافة إلى عرض آراء الفقه المختلفة، لنخلص بعدها إلى تبيان بعض الثغرات في القواعد الدستورية المنظمة للرئاسة المؤقتة للدولة، مع إبداء عدد من المقترحات التي تساهم في سد تلك الثغرات.
Abstract
States are keen to include mechanisms in their constitutions through which the constitutional authorities are formulated and renewed, in addition to the regulations that ensure the presence of these authorities. Constitutions contain mechanisms that govern how state presidential elections proceed prior to the end of each presidential term in order to avoid reaching a void in the presidency.
Regardless of all the measures in place, a state may suddenly find itself in state of presidential vacancy a result of the death or resignation of the president, among other reasons. Constitutions have put in place measures to these address such scenarios and ensure the continuity of the constitutional authorities: persons or entities are specified such that they assume power during presidential vacancies. Many constitutions also have also addressed the potential vacancy that may occur during an interim presidency. Further, constitutions have controls for the power of the interim president to prevent the exploitation of this position. These controls may limit powers of the interim president or enforce conditions on some of the powers. The resulting limited powers have substantial impact on other constitutional authorities in the country, particularly the executive and legislative authorities.
In Egypt, which entity holds the presidential power in instances of presidential vacancies? Does this entity vary between cases of temporary vacancy and permanent vacancy? What is this entity in situations of compound presidential vacancies? What is this entity in times of war?
The above questions are discussed in this paper by examining successive Egyptian constitutions and how they have dealt with these issues, as well as by presenting the views of the various jurisprudence. In conclusion, we identified some gaps in the constitutional rules that regulate the interim presidency in Egypt. We also propose various ways of addressing the gaps.
