ملخص:

يعتبر القضاء الدستوري فرع من فروع القانون العام  و يعمل على مراقبة  دستورية القوانين كاختصاص تقليدي يقضي بالتأكد من مدى احترام القانون و مطابقته لروح القوانين الدستورية التي تنظم سير و عمل السلطات العامة داخل الدولة ، و تضعها هيئة تسمى السلطة التأسيسية الأصلية و تقوم بتعديليها هيئة تسمى بالسلطة التأسيسية الفرعية، و يهدف هذا المقال إلى دراسة كل ما له علاقة  بالقضاء الدستوري، في حين كانت إشكالية الدراسة قد تمحورت في سؤال محوري مفاده مساهمة القضاء الدستوري في الحفاظ على توازن و سمو الدستور، و ذلك من خلال دراسة و تحليل مختلف مجموعة من النصوص القانونية، كما جاءت مؤكدة على أن القضاء الدستوري يستمد قوته  من خلال ترسيخ  مفهوم  العدالة،المساواة ،كما أوصلتنا الدراسة إلى عدة استنتاجات أهمها: أن القضاء الدستوري  عرف مجموعة من التطورات  و يعتبر الضمانة الأهم لحماية الحقوق و الحريات الأساسية.

Abstract

The constitutional judiciary is considered a branch of public law and works to monitor the constitutionality of laws as a traditional competence that requires ensuring the extent of respect for the law and its conformity with the spirit of constitutional laws that regulate the functioning and work of public authorities within the state, and it is established by a body called the original constituent authority and amended by a body called the authority subsidiary constituent,This article aims to study everything related to the constitutional judiciary, while the problematic of the study centered on a pivotal question, which is the contribution of the constitutional judiciary to maintaining the balance and supremacy of the constitution, through studying and analyzing a different set of legal texts, as confirmed However, the constitutional judiciary derives its strength from the consolidation of the concept of justice and equality. The study also led us to several conclusions, the most important of which are: The constitutional judiciary has known a number of developments and is considered the most important guarantee for the protection of basic rights and freedoms.
